Wendy’s experience extends across a range of industries, including biotechnology & life sciences, manufacturing, software development, engineering and minerals & resources sectors. Wendy is a qualified Chartered Accountant, Chartered Tax Adviser, and holds a Master of Commerce, a Bachelor of Science, as well as a Diploma of Innovation Management.

Questions And Answers

To be eligible to claim the refundable tax offset, your company or company group must have an annual turnover of less than A$20 million and annual R&D expenditure of at least $20,000.
In addition, the company must be:
* incorporated in Australia, or
* incorporated in another country but be an Australian resident for tax purposes, or
* incorporated in a country with which Australia has a double tax agreement and undertake R&D activities through a permanent establishment in Australia.
Trusts are generally not eligible – except if they are a public trading trust with a corporation acting as a trustee. Companies that are exempt from tax are also not eligible.
Aggregated group turnover is the sum of the annual turnover for all of the following:
* the Australian subsidiary
* any entity connected with the R&D entity in Australia or overseas or any affiliated entity in Australia or overseas.
Any dealings between these entities are excluded and annual turnover is the total ordinary income derived in the income year in the ordinary course of carrying on its business activities. This would include sales revenue or license fee revenue but does not include capital raised.
The R&D Tax Incentive is jointly administered by AusIndustry, on behalf of Industry Innovation and Science Australia, and by the Australian TaxationOffice (ATO). AusIndustry is an operational division of the Department of Industry, Science, Energy and Resources and is responsible for the applicant’s technical compliance. The ATO is responsible for financial and taxation compliance.
You can submit your R&D Tax Incentive application to AusIndustry from the day after the end of your last financial year end but you must submit your application by 10 months after your financial year end. As an example, if your company has a financial year ending 30 June 2023 (FY23), then you can apply to AusIndustry between 1 July 2023 and 30 April 2023 for R&D activities undertaken in FY23. 
Yes, you must apply to AusIndustry each year even for ongoing R&D projects. New applications to AusIndustry and to the ATO need to be made each year that you claim.
The R&D benefit is claimed through the company income tax return, lodged after the end of the financial year. To make a claim the R&D activities must be registered with AusIndustry and a unique registration number obtained. This is included on the ATO R&D Schedule lodged with the company tax return.
To claim under the R&D Tax Incentive, you must spend more than $20,000 on eligible R&D expenses in the financial year you are claiming.  The exception is where the expenditure is incurred to a registered Research Service Provider (RSP) or is a monetary contribution to a Cooperative Research Centre (CRC) under the CRC program.
The R&D Tax Incentive program is designed to incentivise and support innovation, regardless of whether the project ultimately succeeds or fails. If your project failed, you may still be eligible to make an R&D Tax Incentive claim as long as the R&D activities meet the R&D eligibility requirements.
